FAIRWAY MEWS COMMUNITY ASSOCIATION, INC.

RESOLUTION OF THE BOARD OF DIRECTORS PERTAINING TO

CLEANING DRYER VENTS

 

            WHEREAS, the Board of Directors of Fairway Mews Community Association, Inc., is granted the authority to govern and/or administer the affairs of the Community Association, pursuant to Master Deed and By-Laws appended thereto, recorded in the Monmouth County Clerk’s Office on November 27, 1972, in Deed Book 3810, at page 272; and

 

WHEREAS, the By-Laws of Fairway Mews community Association, Inc., Article III, Section 8, allows the Board of Directors to adopt Rules and Regulations regarding the use, operation, maintenance, enjoyment, and occupancy of the dwelling units, and the use, operation, maintenance, enjoyment, and occupancy of the common elements and limited common elements, to amend the same from time to time as it deems reasonable and necessary, which Rules and Regulations shall become binding on all Unit Owners, occupants, lessees, invitees, residents, and guests; and

 

WHEREAS, the By-Laws of each constituent Association provides that each member shall promptly perform, at his own risk, cost, and expense, all maintenance and repair work with respect to the portion of each unit owned by him or her which does not compromise a part of the general common elements, and which if omitted would adversely affect the safety or general welfare of the condominium in which his or her unit is located, or any part or parts thereof belonging in whole or in part to other residents; and each member shall be liable for any damages, liabilities, costs or expenses, including attorney’s fees, caused by or arising out of his or her failure to promptly perform any such maintenance work; in addition, if any Unit Owner fails to perform such work, the Community Association may do so on the owners behalf and charge the reasonable expenses thereof to the Unit Owner; and

 

WHEREAS, the dryer vents are not general common elements, but rather, comprise a part of the individual dwelling units, and service only each particular unit appurtenant thereto; and

 

WHEREAS, the Board of Directors has determined that some Unit Owners do not regularly cause their dryer vents to be cleaned and inspected, which causes a potential fire hazard affecting all surrounding Unit Owners and/or buildings; and

 

WHEREAS, the Board of Directors deems it necessary, desirable, and in the best interests of the Association to promote the safety of the units and their occupants by requiring the professional cleaning and inspection of the dryer vents on a bi-annual basis; and

 

NOW, THEREFORE BE IT RESOLVED, that the following procedures shall amend the Community Association’s Rules and Regulations regarding the responsibility for cleaning and/or inspecting dryer vents as follows:

  1. Commencing on the effective date of this Resolution, each unit and/or Unit Owner shall have their dryer vents cleaned, by a New Jersey licensed contractor, no less that six months (6)* from the effective date of this Resolution, and shall further have their dryer vent cleaned by a New Jersey licensed contractor, no less than every two (2) years thereafter, at the Unit Owner’s sole cost and/or expense.

 

  1. On or before six (6) months* from the effective date of this Resolution, and each subsequent two (2) year period thereafter, every Unit Owner shall submit to the Board of Directors, at the Community Association office, an invoice acknowledged to have been paid in full, indicating that the dryer vent has been cleaned. Once again, the invoice shall be submitted by a New Jersey licensed contractor.

 

  1. In the event the Unit Owner fails to take the action required hereunder, the Association may perform the work itself and charge same to the Unit Owner, and any such charges shall be collected in the same manner as all other assessments by the Community Association, and shall constitute a Lien against the subject unit. In addition, the Community Association may assess a fine, as set forth in the By-Laws, as amended, in any such amounts as shall be determined in the sole and absolute discretion of the Board of Directors.

 

*This time period has been extended to 1 year from the start date of this policy, which is March 1, 2020.
